Terms of Service

These Terms of Service ("Terms") govern your access to and use of attachly.ai ("Service"), operated by BE LABS B.V., a company registered in the Netherlands (KVK: 42022510), with its registered office at Raadhuisstraat 16, 7721 AX Dalfsen ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service

attachly.ai is a web application that connects to your Gmail account via Google's OAuth 2.0 API to index, organise, and display your email attachments in a searchable visual gallery. The Service includes AI-powered search, automatic syncing, and attachment management features depending on your subscription plan.

2. Account Registration

  • You must sign in using a valid Google account to use the Service
  • You are responsible for maintaining the security of your Google account credentials
  • You must be at least 13 years of age to use the Service
  • You agree to provide accurate information and to keep your account information up to date

3. Gmail Access

  • The Service requests read-only access to your Gmail account (gmail.readonly scope)
  • We do not send, modify, or delete any emails or attachments in your Gmail account
  • You may revoke our access at any time through Google Account Permissions
  • Revoking access will prevent the Service from syncing new attachments but will not automatically delete previously synced data

4. Subscription Plans & Billing

4.1 Plans

The Service offers three tiers:

  • Free — limited attachments, storage, and features at no cost
  • Pro — increased limits, AI-powered search, and auto-sync for a monthly or annual fee
  • Business — highest limits, multiple Gmail accounts, unlimited AI queries, and bulk export for a monthly or annual fee

4.2 Payments

  • Paid subscriptions are billed in advance on a monthly or annual basis through Stripe
  • Prices are listed in USD and may be subject to applicable taxes
  • You authorise us to charge your payment method on file for the recurring subscription fees

4.3 Trials

Paid plans may include a 14-day free trial. If you do not cancel before the trial ends, your payment method will be charged for the first billing period.

4.4 Cancellation & Refunds

  • You may cancel your subscription at any time from the Billing page
  • Upon cancellation, you retain access to paid features until the end of the current billing period
  • We do not provide refunds for partial billing periods unless required by applicable law
  • After your subscription ends, your account reverts to the Free plan

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorised access to other users' accounts or data
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated tools to scrape or extract data from the Service beyond normal API usage
  • Resell, sublicense, or redistribute the Service without our written consent

6. Intellectual Property

  • The Service, including its design, code, and branding, is owned by us and protected by intellectual property laws
  • Your data remains yours. We claim no ownership over your Gmail data, attachments, or any content you access through the Service
  • You grant us a limited licence to process your data solely for the purpose of providing the Service

7. AI Features

  • AI-powered search and chat features use third-party AI models to process your queries against attachment metadata
  • AI responses are generated automatically and may not always be accurate. You should verify important information independently
  • We do not use your data to train AI models

8. Service Availability

  • We strive to maintain high availability but do not guarantee uninterrupted access to the Service
  • We may perform scheduled maintenance with reasonable advance notice
  • The Service depends on third-party providers (Google, Supabase, Stripe, AWS) and their availability

9. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" and "as available" without warranties of any kind, either express or implied
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
  • Our total liability to you shall not exceed the amount you have paid us in the twelve (12) months preceding the claim
  • We are not responsible for the loss, corruption, or unauthorised access to your Gmail data caused by Google or other third parties

10. Account Termination

  • You may delete your account at any time by contacting us
  • We may suspend or terminate your account if you violate these Terms
  • Upon account deletion, we will delete your stored data, including attachment metadata, thumbnails, and encrypted tokens, within 30 days

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on the Service. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these Terms shall be submitted to the competent court in Zwolle, the Netherlands.
